CIPP/Lallemand Seminar: A Privacy Shield to Protect an Unsafe Harbour? The EU-US Data Protection Debate and Its Implications for Canada

The Centre for Intellectual Property and Policy (CIPP) welcomes Prof. Bernd Holznagel, Director of the Institute for Information, Telecommunications and Media Law at the University of Münster in Germany, and a leading scholar on information law.

International trade depends increasingly upon the exchange of data. The European Court of Justice "Safe Harbour" decision of 2015 has given rise to a political agreement between the EU and US on transatlantic data flows. This agreement is known as the Privacy Shield.

Is this Privacy Shield framework sufficient to protect fundamental rights? On the other hand, will data flow not ultimately require that jurisdictions such as the EU loosen their own internal requirements so as to produce a level of comity? How should Canada respond to these developments and is a Privacy Shield required here as well?
