Situation 9. Your spouse is considered to be a Quebec resident according to one of the 14 Quebec residency situations

*This is a temporary status; a break in enrolment may impact this status.

Premise: Your spouse is considered a Quebec resident according to one of the other 13 Quebec residency situations.

Note: The definition of "spouse" according to the Act respecting financial assistance for education expenses (R.S.Q., c. A-13.3): "Spouse means the person who is married to, or in a civil union with, and is not separated, legally or de facto, from the student, or the person of the opposite or the same sex who lives with the student in a de facto union with a child of the person or the student."

There are three scenarios for this situation: 

a) Legal Spouse by Marriage or Civil Union

Documents required:

  1. Proof of Canadian legal status

  2. A copy of your marriage or civil union certificate.

  3. Your spouse's file contains all of the documents meeting one of the 13 other situations available to prove that they are a resident of Quebec.

 

b) Common-law Spouse with child(ren)

Documents required:

  1. Proof of Canadian legal status
  2. The sworn statement attesting to one year of cohabitation as proof of your common-law relationship with your spouse.
  3. A copy of the birth (or adoption) certificate for your or your spouse's child. It must state the names of both parents of the child.
  4. Your spouse's file contains all of the documents meeting one of the 13 other situations available to prove that they are a resident of Quebec.

 

c) Common-law Spouse without child(ren)

Documents required:

  1. Proof of Canadian legal status
  2. The sworn statement attesting to three years of cohabitation as proof of your common-law relationship with your spouse.
  3. Your spouse's file contains all of the documents meeting one of the 13 other situations available to prove that they are a resident of Quebec.
