16 November 2016 - "Frontloading in Civil Proceedings"

The Private Justice and the Rule of Law Research Group welcomed Prof. Simona Grossi (pictured above with Prof. Frédéric Bachand and Fabien Gélinas), Loyola Law School (bio), on Wednesday, November 16 at 11:30 am in NCDH 203 as part of Prof. Gélinas' Resolution of International Disputes course. Her scholarship focuses on civil procedure and federal courts. Professor Grossi is currently Chair of the Association of American Law Schools Executive Committee for the Section on Civil Procedure.

19 October 2016 - "Sports arbitration and the World Anti-Doping Agency"

The Private Justice and the Rule of Law Research Group welcomed Julien Sieveking, World Anti-Doping Agency (WADA) Director (bio), Legal Affairs, on Wednesday, October 19 at 11:30 am in NCDH 203 for a talk on sports arbitration and the WADA.

This took place in Prof. Gélinas' Resolution of International Disputes course.

Symposium on Governance & Constitutionalisation in International Arbitration

12-13 March 2015, Faculty of Law, McGill University

The Private Justice and the Rule of Law Research Group and the McGill Arbitration Student Society held a two-day Symposium on March 12-13, 2015. The first day featured an arbitral moot opposing McGill and Queen's, and the second day, a panel with noted arbitration experts.

(In French only) L'Institut de médiation et d’arbitrage du Québec (IMAQ) tenait son 4e colloque à McGill. Parmi les questions abordées: Comment l’arbitrage permet-il de résoudre les litiges commerciaux de manière plus efficace et plus rentable ? La rédaction de la convention d’arbitrage. Le choix des arbitres. L’organisation et la gestion de l’instance arbitrale. Le Québec devrait-il se doter d’une véritable institution d’arbitrage ?

(In French only) Ce mini-colloque a traité de la preuve du droit étranger devant nos tribunaux et tenté de donner des réponses pratiques aux principales questions que celle-ci soulève, en plus d'offrir un regard comparatif avec les approches adoptées dans d'autres juridictions. Dans quelles circonstances les tribunaux peuvent-ils prendre connaissance d'office du droit étranger, et de quelle façon les plaideurs peuvent-ils en faire la preuve? Quelle est la conséquence de l'absence d'une telle preuve? Qu'est-ce qu'un « certificat de jurisconsulte »? Quel est le rôle des experts appelés à témoigner à l'égard du droit étranger? Doivent-il se contenter d'en établir le contenu ou peuvent-il être appelés à appliquer ce droit aux faits en litige? Par ailleurs, quel usage nos tribunaux font-ils de la doctrine et de la jurisprudence étrangère lorsque vient le temps de trancher les litiges?

The Model Law After 25 Years: Global Perspectives on International Commercial Arbitration, November 24-26, 2011

The UNCITRAL Model Law on International Commercial Arbitration has been extremely successful at fostering transnational understandings in key areas of the law of arbitration. McGill University, in partnership with UNCITRAL, organised this global conference, which took stock of what has been achieved and offered a hard look at the current and future challenges facing the law of arbitration. Speakers addressed recurring issues in the implementation and application of the Model Law and took a close look at the ongoing process of harmonization it set in motion more than 25 years ago.

  • McGill participated in a workshop for parliamentarians in Vietnam as part of the process for a comprehensive review of that country's arbitration law. Professor Fabien Gélinas was the McGill instructor in this workshop.

  • Round table discussion where European and Canadian international arbitration specialists critically analyzed Emmanuel Gaillard’s Les aspects philosophiques du droit de l’arbitrage international, and also discussed ongoing controversies regarding the proper role of public order in this field.
